Understanding Equitable Distribution
Missouri is an equitable distribution state, meaning that the court takes into account several factors in dividing a couple’s property in the event of divorce. Chief among them is the determination of marital and nonmarital property. Marital property is defined as any property acquired by either spouse after the marriage, excepting certain property acquired by gift or inheritance or excluded by valid agreement of the parties.
After the property is determined, the financial needs of both parties are considered and property is divided equitably, not necessarily equally. Issues of property valuation can get incredibly complex.
