Estate Planning: Protecting Your Decisions
Do you know what would happen to your assets in the event of your unexpected death or incapacitation? Would assets be transferred to your family, or another desired party, or family members that you don’t even know?
Estate planning is the process in which an individual or couple arranges for asset transfer during life or at death. From my law office in Chesterfield, Missouri, I can help you create an estate plan that addresses financial and health care-related issues in the event of death or incapacitation. It may include:
- Wills and/or trusts
- Living wills or health care powers of attorney
- Living trusts, which offer unique benefits
- Financial powers of attorney
- Transfer of assets including beneficiary deeds
- Probate proceedings
Failure to ideally plan for an estate can cost thousands or tens of thousands of dollars, with improper parties obtaining authority over assets and decisions and the probate process.
What Is Probate?
Probate is the legal process of administering the estate of a deceased person, resolving all claims and distributing the deceased person’s property when there is no trust or proper beneficiary designation. The process often takes a minimum of eight months and can easily last over an entire year. There are minimum lawyers’ fees, and it is public as well as paperwork-intensive. Worse still, you are not in control of choosing the appropriate executor or the persons to receive your assets.
